Graduates’ Sharing

Christopher K.H TO
Ivan SIN

It is our utmost pleasure to be invited by the School of Law, City University of Hong Kong, to share with you our experience of serving as a Judicial Assistant at the Hong Kong Court of Final Appeal (“JDA”).

JDAs are appointed by the Judiciary on a yearly basis. The scheme was launched under the auspices of Chief Justice Andrew Li in 2009, and has matured over the years. JDAs are employed on a contract basis for a period of about a year from the beginning of September each year to the end of August in the following year.

During our appointment, we worked in the Court of Final Appeal building, which is one of the Hong Kong’s oldest historical buildings at the heart of Central. As JDAs, we got to see the ins and outs of the appellate process and work closely with the appellate judges (“Judges”). For example, we had read into the cases coming before the Court and conducted legal research as directed by the Judges. We also prepared bench memoranda on appeals and leave applications. Other than working with local permanent and non-permanent judges on a day-to-day basis, fortunately in this year, we also got to work with six overseas non-permanent judges who come to Hong Kong on a rotation basis. It was really our pleasure to discuss cases with the Judges and we had learnt and benefitted a lot from our exchanges with the Judges.

Another primary duty of us was to prepare summary of facts before substantive hearings and press summary after judgement had been finalised, they were prepared for the benefit of the public and the press. As the Court is often tasked to adjudicate on the most important legal issues of our common law system, while we found it exciting and challenging when preparing these summaries which dictated the position of the Hong Kong Court in those important legal issues, it was rewarding to know that our works had benefited the public and the press in enabling them to have a more thorough understanding of our legal system.

The types of cases coming before the Court are diverse. In our year, we came across cases involving Constitutional and Human Rights Law, National Security Law, Criminal Law and Procedure, Commercial Litigation and beyond. Through working on cases of diverse nature, we gained exposure to different areas of law and strengthened our knowledge in those areas.

We are most grateful that we had the opportunity to spend a year on this journey, it was fruitful, unforgettable, and rewarding. To put it precisely, the experience of being a JDA goes beyond an ordinary working job, it is an all-round experience of having the chance to observe and get exposure to the appellate process of the Court, and the daily works and practices of the Judges. We strongly recommend all law graduates to give a try in making an application for the position, and we wish everyone of you a very successful career ahead.
